We may revise these terms and conditions from time to time. All changes will be effective immediately upon posting of these revised terms and conditions. 2. Registration

You must register as a member of Niche Nation in order to use some services, including but not limited to:

  1. Order products through this
  2. Book service and

When registering as a member, you must confirm your agreement to these terms and conditions and provide your personal information that is true, accurate and current in all respects. 3. Orders

3.1 Accepting orders

Only registered members of Niche Nation Group can order products through this website and store. The order will be deemed accepted when we have received your payment and you have received an order confirmation email from Niche Nation with the order number.

3.2 Niche Nation does not accept or cancel the order

Your order will not be accepted or will be canceled if:

  1. technical or connection errors and other reasons beyond the control of this website;
  2. The order contains false, omission or incorrect information (e.g. wrong product price – please refer to section 5 on price for details);
  3. We are unable to authorize payment for your purchase;
  4. your failure to comply with or to comply with these terms and conditions;

If your order is not accepted for any reason, our customer service will contact you as soon as practicable by email or telephone, if payment has been posted, and will arrange a refund. Please refer to Clause 8 (Refunds) for details.

The items in the “Shopping List” and “Shopping Cart” do not constitute an “order” for the product, and we do not maintain inventory for the products in the “Shopping List” and “Shopping Cart”.

3.3 Consent

By pressing the “Pay” button, you confirm that:

  1. You agree to the shopping terms and conditions set out in these terms and conditions;

3.5 Restrictions on resale and commercial exploitation

All products sold on this website are limited to your personal use or gift, and any resale or commercial use is strictly prohibited.

If there are any unusual purchases that we believe are not for personal use, our customer service specialists will email or call you to follow up.

4. Price

Prices are in Thai Baht and only payment in Thai Baht is accepted.

We reserve the right to adjust prices at any time, and the new prices are effective immediately when displayed on this website. Price adjustments do not affect orders accepted on this site prior to the publication of the new price.

The original and reduced prices on this website may differ from those shown in Niche Nation stores. Although the order items are picked up at the Niche Nation store, the discounts and discounts offered by the store

5. Payment

5.1 Acceptance of payment methods

5.2 Payment Procedure

The amount shown on all orders must be paid in full in Thai Baht without deduction of any bank charges. Any bank charges incurred shall be borne by you.

5.3 Liability

You represent that the credit card or payment method used is owned by you (if you are over the age of 18) or owned and approved by the parent or guardian who registered the account on your behalf (if you are under the age of 18) and is valid. All information you provide to us is accurate and true. If the card issuer refuses to authorize payment, your order will be canceled.

5.4 Security

The payment process complies with strict international security standards set by the payment industry to ensure that your shopping process is safe and secure. If you register as a member on this website and decide to store your card information, your information will be fully encrypted and will only be used to process the transactions you have instructed, and will be securely stored in the payment system (full compliance with PCI DSS 3.4 Criteria specified as a Tier 1 Service Provider). 5.5 Invoice

A hard copy of the invoice will be sent to the shipping address you specify with the order. For online ordering and store pickup, a printed invoice will be attached when picking up the goods.

6. Delivery and Pickup

6.1 General

We provide two delivery methods: 1) You can choose to deliver to the address you specify (delivery order) or 2) to pick up at the designated Niche Nation store (online order for store pickup).

For delivery orders, you will receive an email notification that the goods have been delivered to the address you specified, and for online pick-up orders, you will receive an email notification that you can pick up the goods at the designated store.

6.2 Delivery orders

Items for a delivery order will be delivered to the address you specify on your order. If you change the delivery address after placing the order, please contact Niche Nation Customer Service by email to aff[email protected] within 2 hours after placing the order.

Changes to the shipping address may result in delayed delivery or additional delivery charges. If the request to change the address cannot be made within 2 hours after placing the order, Niche Nation does not guarantee that the goods will be delivered to the latest address.

6.3 Online ordering and store pickup (Click-and-Collect)

You can choose to pick up the goods at the Niche Nation store specified on the order. You will receive an email notifying you that you can pick up your order in store.

You must present the QR code in the notification email when picking up the goods. Our staff may request your membership card or other personal data to verify your identity. When you pick up the goods, you must sign the receipt confirmation. Once you sign, you accept the risk of the goods at the same time.

If the goods are picked up by a third party, photo identification of the authorized person must be presented together with your authorization letter, which must include the authorized person’s full name and identification number and be signed by you.

If the product is a gift to a third party, the third party recipient must present the QR code on the notification email. Our staff may request the buyer’s membership information to verify identity. The recipient must sign the receipt confirmation and your acceptance of the recipient’s signature is proof of our delivery and fulfillment of the order. After the recipient picks up the goods, you accept the risk of the goods at the same time.

6.4 Delivery/Pickup Time

Delivery orders will only be delivered during the business hours of the courier company’s business day. Delivery to remote areas may take longer than generally expected.

If the recipient is not at the specified delivery address or fails to collect the shipment, our Customer Service will contact you via email or phone to arrange re-delivery. If the courier fails to deliver twice, the order will be considered canceled.

For orders placed online for in-store pickup, the items will be stored at the designated store for 2 weeks from the date the pickup notification email is sent. If you or the recipient fail to pick up the order in person or if you fail to pick up the order at the designated store, the order will be deemed to be canceled.

Refunds will be made to your original payment method. Lenses will not be refunded if the product ordered is a prescription spectacle frame and lens. Please refer to Article 8 (Refunds) for details.

During busy periods and special days, delivery and/or pickup times may vary. Severe weather conditions may cause delivery delays. Customer Service will notify you of the rescheduled delivery date and time as soon as possible.

6.4.1 Sunglasses, Frames, Complimentary Gifts and Gift Cards

We endeavor to deliver the goods to your designated delivery address within 5 to 7 business days of receipt of the order. You will receive an email notification of your delivery/collection time. We do not guarantee delivery in exactly the estimated time.

6.4.2 Prescription spectacle frames and lenses

We endeavor to deliver the goods to your designated delivery address within 14 business days of receipt of the order. You will receive an email notification of the delivery/pickup time. We may change the estimated delivery time for reasons including but not limited to inaccurate prescription information, delay in production time, product out-of-stock and product quality issues. We do not guarantee that the estimated time will be fully delivered. Custom-made spectacle frames and lenses take longer to make, so the delivery time also takes longer.

6.5 Delivery errors

If the order is not delivered within the estimated delivery time, please contact Niche Nation Customer Service aff[email protected] to track the status of the shipment.

If your order is not successfully delivered to you, our Niche Nation Customer Service will contact you via email or phone to reschedule delivery.

If an item is damaged upon delivery, you may return the damaged item for a refund. You are also required to take pictures of the delivery box of the goods and the damaged goods immediately upon discovery of damage.

6.6 Liability

Once you have received the product, all risk of damage to or loss of the product is at your own risk. If you choose to pick up the goods at the designated store, all risk of damage or loss of the goods will pass to you when you or a third party who collects the goods on your behalf picks up the goods at the store.

7. Refund

The refund policy only applies to online orders placed at Niche Nation.com, and does not apply to transactions made at Niche Nation stores.

We do not offer an exchange service, but you can return the purchased product for a refund in accordance with these terms and conditions, and then purchase the appropriate product on this website.

7.1 Return and Refund Requirements

Subject to the terms contained herein, you may request a refund within 7 days of receipt. You can request a full refund for sunglasses, frames and complimentary gifts, while prescription frames and lenses are only available for a frame refund. Lenses are not refundable.

For any questions related to prescriptions, please bring the prescription frames and lenses to our store within 30 days after receipt. Our

optometrists will assist you in dealing with the problems and provide professional advice, and rearrange the lenses if necessary. Make sure the prescription is accurate and appropriate.

7.2 Return and Refund Policy

  1. Items must be returned in new and original merchantable condition: all labels, warranties, care instructions, catalogs, product labels, certificates of authenticity, eyeglass cases, dust bags, packaging included with the item and other accessories, must be in good condition and returned Niche Nation may, in its sole discretion, decide whether the returned goods remain in their original merchantable condition, and such decision is final.

7.7 Abuse of Return and Refund Service

If we find any suspicious or unusual returns and/or refunds, our Niche Nation customer service will follow up with you by email or phone. We will refuse such requests at our absolute discretion.

8. Gift Cards

The gift card can only be used for shopping at Niche Nation stores in Thailand. Gift cards are not valid for purchases on Nichenation.com.

Please refer to the gift card page for detailed terms and conditions. All matters and disputes are subject to the final decision of Niche Nation.

9. Appointment service

You can make reservations for the following services provided by “Niche Nation Stores” through this website:

  1. Make an appointment to try on the product (reservation online)
  2. Lens consultation
  3. eye examination
  4. Zeiss Optometry Center Eye Health Service

All the above services can be booked online and provided by designated stores of Niche Nation.

Online reservation service is only available to members. Non-Members can also book the above services through the website, however the minimum service charge for the eye exam is 1,500 THB ( to be paid at the shop).

Only by purchasing a product in the stores, a service fee will be exempt.

9.1 Accepting Appointments

To make an appointment for any of the above services, you must complete an appointment form. You will be notified by email that we have received the request. Our Niche Nation customer service or store staff may reconfirm your reservation details by email or telephone. When the product arrives at the “Niche Nation Store”, you will receive a confirmation email that your appointment has been accepted.

We reserve the right to accept or reject any appointment at our absolute discretion.

9.2 Change appointment

You will receive a notification email confirming the change or cancellation of your appointment.

9.3 Product reservation

You may request to reserve a try-on store product, subject to the following conditions:

  1. Reserve up to three products at the same time;
  2. If you fail to make an appointment at the designated store within the designated service time, the appointment will be deemed to be canceled and the reserved product will be returned to the You will receive a cancellation notification email.

10. Maintenance and Repair

Goods purchased from retail stores and this website are covered by maintenance and repair services.

10.1 Maintenance

If the products purchased from Niche Nation have factory defects, they can enjoy maintenance services including free repairs or free replacement parts within one year from the date of purchase. Free repair and replacement service does not apply to products damaged by misuse or accident and/or products repaired by unauthorized third parties. Charges apply for any repair/replacement requests made one year after purchase.

There is no contractual warranty for the lenses of sunglass products.

10.1.1. Prescription Lens Products

We offer a 180-day warranty on prescription lens products. If you have any questions about your prescription, please bring your prescription frames and lenses to our store within 180 days after picking up the order. Our optometrist will assist you in dealing with the problem and provide professional advice, and reschedule the lenses if necessary , to ensure that the prescription is accurate and appropriate.

Our warranty only accepts replacement of prescription lens products purchased from Niche Nation and prescribed by an authorized Niche

Nation optometrist. Warranty does not cover prescription lens products prescribed by third parties.

You must provide the original invoice and prescription frames and lenses for us to process the request. We reserve the right to refuse requests if you fail to provide all required documents.

10.2. Maintenance

We only accept requests to provide repair services for products purchased directly from Niche Nation stores or this website. We do not repair products purchased from third parties or merchants authorized by the brand.

You can repair the product according to the maintenance requirements.

For products that are not covered by warranty, we will evaluate the scope of repair for your product and provide a quotation and estimated repair time.

You must bring the product and the original invoice to any Niche Nation store and must sign a confirmation letter to allow Niche Nation to keep the product for the relevant purpose.

We reserve the right to refuse repair requests at our absolute discretion. The decision of Niche Nation is final.

We will do our best to provide quality repair service, but do not guarantee that all products subject to repair will be repaired properly. The time and cost of completing repairs depends on many factors, including the extent of damage, parts availability and product materials, and therefore cannot be guaranteed. Whether the product can be repaired or not is the final decision of the brand supplier.
